VOO369 Terms of Service

These Terms govern use of VOO369 and its related website, application, features, and services.

VOO369 is operated by Dynamo Contracting LLC.

By creating an account or using VOO369, a user agrees to these Terms.

1. VOO369

VOO369 is a digital identity and profile platform that may allow members to:

- create a permanent VOO;

- create multiple Sides;

- publish public profiles;

- use one permanent QR;

- use SHIFT and Smart SHIFT;

- share Direct Side URLs;

- use VOO Perks;

- share VOO369;

- participate in referrals;

- build a private VOO Network;

- participate in VOO Spark if approved;

- use other features offered through the service.

Features may evolve over time.

2. Accounts

Members are responsible for:

- providing accurate account information;

- protecting their authentication methods and devices;

- activity conducted through their accounts;

- notifying VOO369 if unauthorized account access is suspected.

Members may not impersonate others or materially misrepresent identity or affiliation.

3. Member Content

Members are responsible for content they publish, including:

- profile information;

- images;

- artwork;

- links;

- contact information;

- Side content;

- VOO Perks;

- promotional offers;

- other information submitted for publication.

Members retain ownership of content they own.

By using VOO369 to publish content, members grant VOO369 the limited permission reasonably necessary to host, display, process, resize, transmit, and operate that content as part of providing the service.

Members represent that they have the necessary rights to publish submitted content.

4. Public Information

Published VOOs and Sides may be publicly accessible.

Members determine what information they intentionally publish.

VOO369 cannot control third parties who save, screenshot, download, copy, or redistribute information a member intentionally makes public.

5. Acceptable Use

Members may not use VOO369 to:

- violate applicable law;

- impersonate another person;

- commit fraud;

- engage in phishing or credential theft;

- distribute malicious software;

- harass, threaten, or abuse others;

- promote illegal goods or services;

- infringe intellectual-property or privacy rights;

- interfere with VOO369 security or infrastructure;

- bypass access restrictions;

- manipulate referrals;

- manipulate analytics;

- manipulate rewards or billing;

- create prohibited self-referrals;

- abuse automated systems.

VOO369 may investigate or restrict activity reasonably believed to violate these Terms.

6. VOO Perks and External Links

Members may use VOO Perks and other links to direct visitors to third-party products, offers, booking systems, affiliate links, services, or websites.

Unless explicitly stated otherwise, VOO369:

- is not the seller of those third-party products;

- does not guarantee third-party offers;

- does not control third-party websites;

- does not guarantee that discounts or promotions remain available.

The member publishing an offer is responsible for its accuracy and legality.

7. Trial

VOO369 currently offers a 7-day free trial.

The account trial does not require payment-card information.

A paid subscription begins only when the member affirmatively proceeds through the paid checkout flow.

The account trial alone does not authorize a charge. If a member chooses to subscribe through Stripe Checkout, Checkout includes a 7-day subscription trial and authorizes recurring billing after that trial unless canceled. The billing dates and amount are shown in Checkout.

8. Paid Subscription

The current standard VOO369 subscription price for new paid subscriptions is $6.99 USD per month, following the 7-day free trial described above.

Existing members who began and maintained a paid subscription at $5.99 USD per month remain at that price while that subscription continues without cancellation. If such a member cancels and later resubscribes, the price available at the time of resubscription applies.

Once a member completes subscription checkout, the subscription renews monthly after its subscription trial until canceled through subscription management.

Stripe or another disclosed payment provider may process the transaction.

Pricing and billing frequency are displayed before purchase.

VOO369 may change pricing for future billing periods with appropriate notice where required by law.

9. Cancellation and Refunds

Members can open subscription management from their account billing settings to cancel an active subscription.

Cancellation prevents future renewal according to the applicable billing terms.

Payments already processed are generally non-refundable except where required by applicable law or where VOO369 expressly agrees otherwise.

10. Payment Providers

Payments may be processed by third parties including Stripe.

Third-party payment services may be governed by their own policies and terms.

11. Referrals

VOO369 may provide:

- referral links;

- personal QR codes;

- VOO Points;

- referral attribution;

- VOO Network functionality;

- other referral benefits.

Qualification is determined by VOO369 systems and applicable program rules.

VOO369 may reject or reverse benefits associated with:

- self-referrals;

- duplicate accounts;

- fraud;

- manipulation;

- canceled or refunded activity;

- disputed transactions;

- failed subscriptions;

- non-qualifying accounts.

Referral participation does not guarantee rewards or income.

12. VOO Spark

VOO Spark is an approval-based promotional program.

Approved Sparks may qualify for compensation under the applicable Spark terms.

Under the current VOO Spark model, an approved participant may earn $2 USD per month for every personally referred qualifying active paid VOO369 member.

A personally referred member qualifies only when:

- the referral is personally attributed and direct;

- any applicable trial has completed;

- payment has succeeded;

- the paid membership is currently active;

- the payment has not been refunded or disputed;

- the membership has not been canceled and is not failed or uncollectible;

- the referral is not a self-referral; and

- the referral remains valid under applicable settlement and anti-abuse rules.

Clicks, leads, trial-only accounts, failed payments, refunded members, inactive members, and self-referrals do not qualify.

Qualifying earnings are subject to a 15-day hold. The minimum payout is $10 USD, and smaller balances carry forward. Spark earnings apply only to direct personal referrals. There are no downlines or recruiting commissions.

VOO Spark participation does not create:

- employment;

- partnership;

- franchise;

- agency;

- joint venture;

- multi-level marketing relationship.

Spark participants are responsible for applicable advertising, disclosure, tax, and promotional requirements.

Earnings are not guaranteed.

VOO369 may withhold or reverse compensation associated with fraudulent, refunded, disputed, canceled, failed, or otherwise non-qualifying activity.

13. VOO Network

VOO Network may allow members to privately see accounts directly connected through their own sharing or referral activity.

A VOO Network relationship does not grant ownership, control, employment, or financial rights over another member.

Members may not use network information to harass, pressure, or improperly contact other members.

VOO369 does not provide multi-level referral earnings merely because a member exists within another person's network.

14. Analytics and VOO Impact

VOO369 may provide private metrics regarding engagement.

Metrics may include:

- profile activity;

- QR activity;

- link clicks;

- VOO Perk interactions;

- contact saves;

- referral activity;

- network growth.

Analytics are informational and may include reasonable delays, filtering, estimation, or technical limitations.

VOO369 does not guarantee that every interaction will be recorded.

15. Authentication

VOO369 may provide supported authentication methods including:

- email verification;

- MFA;

- passkeys;

- compatible biometric or device authentication;

- recovery mechanisms;

- other Clerk-supported methods.

Members are responsible for securing their devices and authentication methods.

VOO369 may require additional verification when reasonably necessary for account security.

16. Intellectual Property

VOO369 branding, software, interfaces, logos, designs, and original platform materials belong to or are licensed to the legal operator.

Members may not unlawfully copy, reproduce, reverse engineer, resell, or commercially exploit protected platform materials.

17. Suspension and Termination

VOO369 may suspend, restrict, or terminate accounts for reasons including:

- Terms violations;

- fraud;

- abuse;

- security threats;

- unlawful activity;

- interference with other members;

- substantial platform risk.

Immediate action may be taken where reasonably necessary to protect users or the service.

18. Service Availability

VOO369 aims to provide reliable service but cannot guarantee uninterrupted or error-free operation.

Maintenance, outages, third-party failures, technical incidents, or security events may affect availability.

19. No Guarantee of Results

VOO369 provides tools.

VOO369 does not guarantee:

- traffic;

- sales;

- customers;

- referrals;

- engagement;

- business success;

- income;

- audience growth;

- investment performance;

- financial results.

20. Third-Party Services

VOO369 relies on third-party services for functions such as:

- hosting;

- authentication;

- payments;

- storage;

- analytics;

- infrastructure.

Those providers may have separate terms and policies.

21. Disclaimer

To the extent permitted by applicable law, VOO369 is provided on an “as available” basis.

VOO369 does not guarantee that every feature will always be uninterrupted, error-free, completely secure, or suitable for every purpose.

22. Limitation of Liability

To the extent permitted by applicable law, VOO369 and Dynamo Contracting LLC will not be responsible for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the service.

Nothing in these Terms excludes liability that cannot legally be excluded.

23. Indemnification

To the extent permitted by applicable law, members are responsible for claims or losses arising from:

- unlawful content they publish;

- infringement of another person's rights;

- misuse of VOO369;

- violation of these Terms.

24. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

25. Changes

VOO369 may update these Terms as the service evolves.

Material changes may be communicated through reasonable website, application, or account notices.
